A faulty pump, a defective formula or a broken brush is covered for two years. Using up a formula is not a defect.
- Legal framework: European consumers have a legal guarantee of conformity under Articles 1649bis to 1649octies of the Belgian Civil Code and Book VI WER, transposing Directive (EU) 2019/771 (Law of 20 March 2022).
- Consumable oral care (nature of the goods): under Article 1649quater, §4 of the Belgian Civil Code, the guarantee applies taking into account the nature of the goods. KARMICARE formulas are consumable cosmetic goods designed for an intended cycle of daily use (for example 30 to 60 days, depending on volume and frequency). The guarantee does not mean a formula lasts two years once opened. Normal depletion, natural bristle wear, or use beyond the Period After Opening (PAO) or minimum durability date is not a lack of conformity.
- What is covered: latent manufacturing defects and mechanical non-conformities present at or arising from delivery: failure, jamming or breakage of the airless pump while formula remains inside under normal use; formulation defects such as premature separation, contamination, abnormal discolouration or instability before the expiry date or PAO when stored as recommended; defective seals, leaking containers or structural defects in toothbrush handles or floss dispensers.
- Remedies: for a verified manufacturing or packaging defect, KARMICARE provides a free replacement of the defective unit (or a replacement bottle or pump). If replacement is impossible or disproportionate, you are entitled to a proportionate price reduction, or to end the contract with a full refund.
- Notification: tell us within two months of discovering a lack of conformity (Art. 1649quater, §2 Belgian Civil Code) by emailing care@karmicare.com with your order number, a description, and photos or a video of the defect.
- Exclusions: normal depletion of the formula; natural wear of toothbrush bristles; damage from improper storage (extreme temperatures, direct sunlight, moisture or tampering with the bottle); use after the PAO or expiry date.
Examples
Normal product depletion: excluded Example: asking for a replacement because the formula has been used up.
Why: consumable cosmetics are designed to be used up; normal exhaustion fulfils the contract.
Normal bristle wear: excluded Example: bristles splaying or softening after 2–3 months of daily brushing.
Why: routine wear and tear; dentists recommend replacing a toothbrush every 2–3 months.
Expired Period After Opening (PAO): excluded Example: a bottle opened 18 months ago dries out.
Why: stability is certified only within the indicated PAO.
Improper storage: excluded Example: a bottle left on a radiator or in a hot car separates.
Why: heat damage caused by storage against the storage guidelines.
Airless pump failure: covered Example: the piston jams or the head breaks in week 2 under normal use while formula remains inside.
Remedy: free replacement unit.
Formulation or batch defect: covered Example: curdled, separated or discoloured formula on first use.
Remedy: free replacement or full refund.
Unopened stock within shelf life: covered Example: a properly stored, unopened plan bottle goes bad before its printed expiry date.
Remedy: replacement.
Structural toothbrush or floss defect: covered Example: a handle snaps on day 4 or bristles shed on first use.
Remedy: replacement.
